APPLICATION BY SURVIVORSHIPS

An Application By Survivorship refers to a principle commonly applied in Joint Ownership arrangements, particularly in joint tenancy and tenancy by the entirety. It stipulates that when one owner dies, the deceased owners share automatically transfers to the surviving owner (s), rather than being passed on according to the deceased's will or intestacy laws. This means that the surviving owner(s) inherit the deceased owner's share without the need for probate or other legal processes. This is completed by survivorship application through Landgate.

APPLICATION FOR NEW TITLES

An application for new land titles is the formal process whereby the appropriate requests are submitted to the relevant land authority or government agency (Landgate) to establish a new legal title for a parcel of land.

Your settlement agent can prepare and submit the necessary application to Landgate, the application will be reviewed, and once all necessary requirements are met, the land authority will issue a new title.

Once your land parcel is "In Order For Dealing" this means that the necessary details and checks have been completed, this includes information about the land, such as its location, boundaries, and intended use, surveys, zoning approvals, and any relevant permits and the application for new titles can commence.

The process of obtaining new titles is used in the instance of subdivision and includes reviewing any encumbrances or restrictions associated with it.
